Summary:
The concentration of lead (Pb) in the air in Hayden is occasionally above the federal limit established in the federal National Ambient Air Quality Standards (NAAQS). ADEQ submitted a nonattainment State Implementation Plan (SIP) to the U.S. Environmental Protection Agency (EPA) in March 2017. The SIP was approved by EPA on Nov. 14, 2018. On Jan. 31, 2022, EPA found that the Hayden area did not attain the 2008 Pb NAAQS by the statutory attainment date of Oct. 4, 2018.
In September 2024, ADEQ submitted a revised nonattainment area SIP to EPA, which included an updated operating permit establishing additional controls for the ASARCO smelter to reduce Pb emissions and enable the area to attain the NAAQS by Jan. 31, 2027.
On Dec. 9, 2025, ADEQ submitted a Notice of Final Rulemaking to the Secretary of State. This rulemaking amends existing rules and adopts new rules in the Arizona Administrative Code (A.A.C) Title 18, Chapter 2, Article 13 (SIP Rules for Specific Locations) to codify the aforementioned permitting conditions included in the September 2024 Hayden Pb SIP revision.
On Dec. 10, 2025, ADEQ submitted another SIP revision to EPA to incorporate the A.A.C. Title 18, Chapter 2, Article 13 rule revisions and is currently pending EPA review.
