ADEQ maintains a list of completed rulemakings on our website for two years following their effective dates. Following is a list of completed rulemakings related to the Water Quality Division:

Summary:

ADEQ is pursuing a regular rulemaking to amend Arizona Administrative Code Title 18, Chapter 11, Section 216 The Protected Surface Water List, Table B WOTUS Protected Surface Waters, by adding a protected surface water. ADEQ seeks to add a mitigation wetland established by the Bureau of Land Management (BLM) as a protected surface water under Appendix B and assign appropriate water quality standards to this wetland.

Summary:

Due to an immediate need for fee increases to maintain the solvency of the MAP fund, and to conform with recent legislative MAP changes, ADEQ amended A.A.C. Title 18, Chapter 4, Article 3 to adjust Drinking Water Monitoring Assistance Program (MAP) fees and create a fee and regulatory structure to allow ADEQ to perform triggered increased monitoring.

Summary:

ADEQ is responsible for the development of the drinking water aquifer water quality standards (AWQS) (see A.R.S. § 49-223). These standards are designed to protect the State's aquifers, all of which have been designated for drinking water-protected use (see A.R.S. § 49-224(B)). The AWQS are used in ADEQ’s Aquifer Protection Program (APP), remediation projects under the Water Quality Assurance Revolving Fund (WQARF), the Voluntary Remediation Program (VRP), and elsewhere. According to A.R.S. § 49-223, ADEQ must open a rulemaking docket for the adoption of MCLs as AWQSs within one year of EPA's establishment of new or adjusted MCLs. Pursuant to the aforementioned statutes, ADEQ adopted four (4) new AWQSs (Bromate, Chlorite, Haloacetic Acids and Uranium) and adjusted three (3) others (Arsenic, Microbiological Contaminants and Total Trihalomethanes). Along with this rulemaking action on standards, ADEQ is adopting an implementation rule to clearly define a procedure for implementing new or adjusted AWQS into issued individual APP permits | View Fact Sheet >

Summary: 

ADEQ revised water quality rules in Title 18 of the Arizona Administrative Code (A.A.C.) through expedited rulemakings. The objective of the rulemakings was to correct typographical errors, update outdated citations and references, clarify language, and fix similar clerical issues in Chapters 4, 5, 9, and 11, which will not add regulatory burden.

Summary:

ADEQ revised the Arizona Administrative Code (A.A.C.) to allow for the expansion of potable reuse for facilities subject to the Safe Drinking Water Act and for pilot, demonstration, or educational facilities. Expanding potable reuse will improve the sustainability of Arizona’s water supplies.

While potable reuse, direct and indirect, was previously allowed under ADEQ’s rules in A.A.C. Title 18, Chapter 9, Article 7, Part E, regulatory specificity in the form of a robust, state-based and authorized regulatory program is needed to support water suppliers’ ability to engage in potable reuse while ensuring protection of public health and the environment in Arizona.
