Summary:

This rulemaking established licensing time frames for Coal Combustion Residuals (CCR) permits as required by A.R.S. § 41-1072 et seq. Summary:

In June 2025, ADEQ implemented an emergency rule to temporarily reduce and temporarily suspend several fees within the Solid Waste Program. This emergency rule was completed to bring certain fees into statutory compliance and to ensure equitable treatment and fee parity throughout the regulated community. In this rulemaking, ADEQ re-established those reduced and suspended fees pursuant to a fee schedule that balances the fiscal health of the Solid Waste Program and the budget constraints of the regulated community subject to the fees.

Summary:

ADEQ is working on rules that will allow ADEQ to establish and operate a Coal Combustion Residuals (CCR) permitting program for Arizona. HB2411 from the 2022 session authorizes these rules and was signed by the Governor on April 25, 2022. An exemption to the rulemaking moratorium was granted to ADEQ on May 2, 2022.

Summary:

ADEQ has finalized an expedited rulemaking to amend 18 A.A.C. 18 (Emergency Planning and Hazardous Materials) to clarify rule requirements without changing their effect, update incorporations by reference, and amend outdated rules. This chapter implements the Arizona State Emergency Response Commission (AZSERC) functions and programs (Article 1) and prescribes curriculum standards for the Hazardous Materials Training Program (Article 2). In addition to improving the rules, ADEQ will be fulfilling its 2023 five-year rule review promises to the Governor’s Regulatory Review Council by updating these rules.

Summary:

ADEQ has finalized rules to update the current solid waste fees. ADEQ has also established solid waste fees for aspects of the program that the department has been overseeing that were not set when ADEQ changed to a fee-based model in 2012. The rules can be found in Arizona Administrative Code, Title 18, Chapter 13, Solid Waste Management. New and updated fees were authorized by House Bill 2367 which became effective on April 9, 2024.
