Summary:
ADEQ is pursuing a regular rulemaking to amend its Hazardous Waste rules in Arizona Administrative Code (A.A.C.) Title 18, Chapter 8, Article 2 to incorporate by reference seven new and modified federal Resource Conservation and Recovery Act (RCRA) regulations promulgated by the US Environmental Protection Agency (EPA) since 2020.
In addition to updating federal incorporations by reference, ADEQ will implement other minor clarifying changes proposed in the 2024 five-year review report approved by the Governor's Regulatory Review Council (GRRC). ADEQ will also revise the methodology for annual Consumer Price Index (CPI) adjustments to hazardous waste program fees in R18-8-260(M)(4) to be consistent with ADEQ's standard approach.
